TERMS OF SERVICE

Please read my ToS in full before filling out the form for a commission, or to be in the waitlist.

The following has been removed:• Section IIIA.7. "If you'd like me to change the original reference sheet that showcases the adopt to reflect these changes, I can do them free of charge as long as they're very minor (changing text, changing colors, slight clothing/pattern changes, slight body type changes), however, anything else may incur an extra fee."• Section IIIA.1. "They will also get a 15% off discount for commissions that feature this adopt, and this CAN stack with Patreon discounts. This CANNOT stack with any other discounts, and does not apply to commercial commissions, already discounted offers, or commissions that are $170 and under."

I. PRIOR TO COMMISSIONING

The client must provide all information necessary to complete the commission. This includes any deadline information. If you need your commission on a specific deadline that's within a month or less, I require that you pay an additional fee. I will not do any commission (besides sketches and emotes) if I'm given less than one week to do it.
The only accepted currency is USD.
The client must pay upfront or 50% before sketch and 50% at the halfway point of a commission via PayPal invoice. The client will be notified once this halfway point is reached. Anything $170 and under needs to be paid fully upfront. Failure to pay the invoice within 48 hours will result in you forfeiting your place in the queue, and I will move on to the next client.
Waitlisted clients must pay when it is their turn in the queue, but they may pay earlier when I give the client a 3-5 day heads-up about me sending an invoice. If you are not in a waitlist, you must be ready to pay within 48 hours of me sending an invoice. Prior discussion will be made concerning when I'd be sending the invoice.
Any amount of money directly sent to me without an invoice will be counted as a tip.
Turnaround times will depend on commission complexity and personal circumstances, however, it's usually a max of 3 months. Waitlisted clients will be notified prior to their turn at least 3 days in advance.
I reserve the right to decline any commission request for any reason.
If the client wants to upgrade/downgrade their commission while in a waitlist (ex. want to go from a sketch to a colored sketch), please let the artist know.

II. AFTER PAYMENT & COMMISSION PROCESS

No refunds will be given once I reach the halfway point of a commission. I will notify the client once we've reached that point. NO REFUNDS for emotes and sketches.
All communication between me and the client in regards to a commission will mainly be conducted via Discord. Communication may also be made via Email, or via Twitter.
I will allow unlimited revisions during the sketch phase, 3 free revisions during the flat color phase, and no other free revisions during the rendering phase, unless they are very minor and not excessive. I will not do any extreme revisions (redoing an entire character/pose, etc.)
If the client wishes to cancel a commission, the refunded amount will be sent based on how much work I've completed. The client will receive the work that I have done up until the refund. If a client asks for a refund on a character design commission, they will not receive full rights to the character, since the design is not yet finalized.
The client cannot under any circumstances force a chargeback. If a refund is requested, I will gladly work with you as long as the halfway point hasn't been reached, and it's not an emote or sketch.
The client cannot change the subject of the commission once it is agreed upon.
If the client is belligerent or inappropriate, and has not responded to warnings about this behavior after I begin on the commission, I reserve the right to cancel the commission and may not issue a refund. This is entirely at my discretion.
If personal circumstances, such as illness, loss of technology, etc. prevent me from finishing a commission on time, I will inform all of my clients immediately.
If the client wants to upgrade their commission at any time during the commission process, they would need to pay the difference. The client cannot upgrade their commission after the halfway point of the commission, and I may deny an upgrade depending on what the client wants to upgrade to.
If the client becomes despondent for more than 3 weeks with no prior notice, I will either refund or cancel the commission without a refund depending on how far along the commission is. Constant pokes will still be done before this deadline via both the client's Discord and e-mail that they have provided.

III. AFTER THE COMMISSION

Commissions will be sent to either the client's Discord or e-mail, or both, in high-resolution, in the form of a PNG. The client will receive a low-res version with the watermark near the face or any other detailed area, as well as in at least 2 corners of the piece, for sharing publicly. The high-res version with only one watermark will be private to the client, and will only have a watermark in the corner of the image. I may post the high-res version to only my Patreon, but it will include the same watermarks as the low-res version would have.
I, the artist, reserve full rights to the image, its distribution, and its use. This includes prints and merchandise (as long as it's not a character owned by the client themselves), advertising via social media, and using it in my portfolio and commission examples, even if a commercial fee was paid.
I, the artist, reserve the right to show any commissions done on my portfolio, Patreon (including high-resolution version and WIP's), YouTube, and all of my listed social media websites.
The client cannot, under any circumstances, omit my signature from the finished piece, or from the process pictures I send. I will ONLY remove the watermark from the final piece if a commercial fee was paid, and in addition to the commercial fee, the artwork is credited to me, the original artist, when it's published or mentioned in any capacity.
All commissions completed fall under personal use unless otherwise specified. If a piece is commercial, then a 300% commercial fee in addition to the original price is added. If the commission will be used commercially for the foreseeable future, a percentage of sales may also be negotiated in addition to the commercial fee. If the client decides to use a commission commercially after its completion, this can be discussed.
If a client wants me to edit an already commissioned piece made by me, they must consult me and receive my written agreement. The client, or any other third party, may not modify or alter any process pictures of the commission, or the finished piece itself without said agreement. The client may NEVER modify or alter any of the aforementioned media with AI, machine learning tools, or anything similar. This includes things like Midjourney, Stable Diffusion, etc.
Clients must not resell the finished commission piece under any circumstances, unless a commercial fee has been paid and explicit consent by the artist has been written. You may NOT take my finished piece, or any of my process pictures, and sell them as NFT's, or anything similar.
The client may repost the finished commission, provided that proper credit is given to me.

IIIA. REGARDING ADOPTS

When the owner pays for the adopt in full, they will receive a high-res version of the adopt, as well as the rights to use it. Watermarks will be removed (except for one in the corner) for the high-res version, which the owner may not share to the public. The owner will also receive a low-res version of the adopt, without the "ADOPT - NOT YET SOLD" watermark. The owner may share this version publicly. They will also get a 15% off discount for commissions that feature this adopt, and this CAN stack with Patreon discounts. This CANNOT stack with any other discounts, and does not apply to commercial commissions, already discounted offers, or commissions that are $170 and under.
Minimum of $50/month bids are acceptable for my adopts. This will be paid via PayPal invoice. Bids made that include any extra art of the adopt are also viable for the $50/month plan. Extra art of the adopt will not be started on until I receive 100% payment of the initial bid for the adopt, as well as at least 50% of the bid of the extra art. The extra art will not be finished after the sketch phase until the rest of the payment is made. If final payment to be made is less than $50, then final payment doesn't need to amount to $50.
Payments of at minimum $50 must be made each month on the day of first payment, without fail. If the bidder fails to make a payment on time, payments already made will be refunded, and the auction will restart. ONLY BID ON MY ADOPTS IF YOU CAN MAKE THESE PAYMENTS ON TIME. Some exceptions to this can be made, based on certain circumstances and if you'd be late with the payment by a few days or weeks - as long as you'll be paying within the month, everything should be good!
The rights that I have listed, as well as the high-res version of any adopt that I sell, will not be relinquished until the bid for the adopt is paid in full.
This adopt CAN be resold. The owner must first get into contact with me prior to this. The adopt CANNOT be sold for less, or for more than what was bid. The adopt can only be sold for more if the owner has bought more art of them, and has therefore increased their value. This adopt cannot be refunded after full payment has been made. You may not resell this adopt, or the art that comes with them, as an NFT.
Adopts are for personal use ONLY; commercial usage incurs an additional fee.
You may make minor edits to this adopt (ex. gender, hairstyle, clothing, backstory, name, etc.) However, please don't change the design of the adopt to where it no longer looks like the original. If you'd like me to change the original reference sheet that showcases the adopt to reflect these changes, I can do them free of charge as long as they're very minor (changing text, changing colors, slight clothing/pattern changes, slight body type changes), however, anything else may incur an extra fee. Do not edit, modify, or alter my drawing that comes with the rights of the adopt - this includes by any third parties, or by AI/machine learning.
Do not use any of my adopts in subjects of extreme fetish art (ex. scat, rape, necrophilia, pedophilia, etc.), offensive, controversial, and/or political content. The owner may contact me, the artist, at any time if they're unsure if what they want to do with the character design falls under this.
This adopt must also be credited to me, whenever possible (ex. character designed by artistotle_art).
If the winner of the auction fails to contact or respond to me within 48 hours, or does not abide by my ToS, they will be blacklisted, made known to other artists, and may have an artists beware made on them. If the winner has failed to respond within 48 hours, the auction will then either restart, or the next-in-line bidder will be contacted.

I can publicly list your name as "anonymous" on my Trello queue, social media, etc. when referring to the commission so that your name will only be known to me. However, I do not do private commissions where I cannot, at least, post WIP's to my Patreon and the final, low-res product to my public social medias.

I can! The fees are as follows:

+60% of cost if deadline within 5 days (ONLY RESERVED FOR EMOTES AND SKETCHES)
+50% of cost if deadline within 1 week
+40% of cost if deadline within 2 weeks
+30% of cost if deadline within 3 weeks
+20% of cost if deadline within 1 month

I only offer a 50/50 payment plan (50% upfront, 50% at the halfway point of a commission).

I offered limited slots for a 15% off commission discount on my Patreon, but that's about it. The only other discounts I offer to the public are YCH's, which are listed at a discounted price, a 25% off discount for INPRNT orders of your final commission if requested, a 30% off discount for buyers who have been scammed/ghosted/had a botched commission, and if you commission me to make a character design, I can also discount your character sheet if the character design was finished within 2 months.

You do not need to pay to get into my waitlist. I usually notify clients about 3-5 days prior to me sending an invoice.

You're free to fill out my form and be placed into my waitlist if I accept your request, so long as there are available slots in said waitlist.

I will only allow early payment when I give you the 3-5 day heads-up about me sending an invoice.
